Call your insurance company. It’s their job to handle this, that’s why you have insurance. If he does try and sue you personally then get a lawyer. If he wins a judgment against you, it doesn’t matter if you don’t have any money right now. They will freeze your bank accounts and garnish your paychecks until the judgment is paid no matter how many years it takes. Like I said, contact your insurance company and speak to a lawyer.

If he sues you and wins he can TAKE everything you own. If what he takes now does’t satisfy the judgement he can come back later, when you do have money, and TAKE it again. You don’t have to GIVE him anything. He’ll take it.
First off, you have auto insurance. That reason you have insurance is for this purpose. You don’t have to worry about personal assets, etc… Your insurance company will take care of it. This guy will not be getting a $ 125k from anyone. You shouldn’t stress. Your personal assets are not involved when you have full insurance coverage. Hopefully you have great insurance!!!
They can garnish your paycheck if you lose and don’t have money. If you had insurance they should have to cover it. If you don’t have money like you state this guy is an idiot to sue you. He is going to spend more on lawyers than he will get from you.
