The New York Legislature put the “No-Fault Law”( http://www.accident-lawyer-new-york.com) into effect in 1973. With this law, every owner of a motor vehicle in New York must carry automobile insurance that will pay for the “basic economic loss.”

Anybody hurt by the vehicle or vehicle driver in the event of an accident. This is called “no-fault insurance” because the loss (only basic economic) must be paid by the owners insurance, no matter whose fault it is. A motorist must have a minimum of $ 50,000 of personal injury protection coverage (a.k.a. “no-fault” coverage).

In certain situations, a person may not be covered by no-fault benefits for several reasons, including intoxicated driving, intent to cause an accident, injury while perpetrating a felony, or having raced the vehicle when they sustained the injury.

Basic economic loss does not include pain and suffering. Actually, the No-Fault Law does not allow an injured person from a car accident to sue the responsible party for pain and suffering unless the injured person received a “serious injury” such as broken bones, dismemberment, or death.

Some of the purposes of the No-Fault Law, include reducing the number of lawsuits that are filed over minor injuries, and insuring that every person injured in a car accident in New York will be restored to health and productivity as swiftly as possible. The No-Fault Law is helpful in that it allows for prompt payment of medical bills and other actual expenses of the injured person without requiring proof that any driver was at fault in the accident. However, the law No-Fault does not allow injured persons to recover money for pain and suffering unless a “serious injury” was sustained.

There is much debate over what can be defined as a serious injury. To begin with, the No-Fault Law itself gives certain types of injuries that automatically qualify as “serious injuries”, such as broken bones, dismemberment, and death. There are several other categories of serious injury defined by No-Fault Law (http://www.accident-lawyer-new-york.com).

There are specific and short deadlines for many types of car accident claims (i.e., a claim for basic economic loss benefits against a no-fault insurance carrier must be made within 30 days of the accident, or no claims will be paid). Proving negligence and a serious injury involves proof that must be attained and shown in a very specific manner. No-fault insurance carriers typically investigate claims to insure that medical expenses, wage loss and other claims are legitimate and/or medically necessary and can deny any claims they deem unnecessary.

Im getting sued from an accident for $125,000. Im a college student with no job. What will happen?

Question by yo : Im getting sued from an accident for 5,000. Im a college student with no job. What will happen? Ok i got an accident back in December. and this guy is suing me because he “claims” he hurt his neck. The accident itself was in a parking lot at very low speed probably less than 1 or 2 mile an hour. This guy came out of the car cussing at me and what not and appeared to me moving around just find. Heck at the end he was even cracking jokes and was like “dont worry just let the insurance handle it” By this I think he was assuming that i would admit that it was my fault to insurance. But I didnt i told them it was his fault. He got pissed about this and called me and then threatened me telling me “mother F’er I will take care of you” and hung up. I told the insurance and what not. But here is the funny part Iam a student in college with no Job plus I live in Texas. I heard that there is laws that say if you dont have any money then they cant take your car or house etc.

Is this true? If I dont have I dont have to pay?

Has he actually gotten a lawyer and started the process of suing you?
Your auto insurance should cover his damages and I suggest you talk to a lawyer.

Question by michelle c : I think my husband is seriously becoming addicted to playing poker, and I can’t stand it much longer? I moved to the US a few months ago, to marry my husband. I knew he liked to play poker, but I feel like its spiriling out of control. He is a very good poker player – he rarely looses, and frequently wins $ 500+, so his ego is becoming over-inflated.

The past week, he has been playing online everyday. On Thursday he was playing from 10-3am, the next day he played online a little bit, and then we went out for dinner…with poker friends. Saturday was poker all day online – I had a minor car accident, and he seemed more interested in playing poker. Then today, he’s playing poker again, and will be playing a tournament tonight. Meals are even eaten infront of the PC!! He claims “theres nothing better to do right now” so he may as well play – how can I argue that??

Once a fortnight he goes out & plays till 9am! It just hurts me, because it was only on Wednesday we had a huge argument about how I thought his playing was becoming obsessive, so he said he would play less, pls help. Best answer:

Any addiction will kill a marriage.
If he won’t go to counseling, then you go. You might also want to start putting some cash away before you NEED to escape.

Gamblers usually brag about their winnings but never tell of their losses. It might be that the $ 500 he wins is at a $ 1,000 loss.

If he doesn’t stop his addiction, you will find your credit ruined soon. Nobody rides a winning streak forever. Online gambling is set specifically for people to lose. I guarantee you he hasn’t told you the entire story.
